Olympic Construction Projects Ownership Tender Management Model
Established working principles and procedures to define responsibilities, rights and obligations of the bidder for the Olympic Construction Projects Ownership Tenders will be according to this model.
This model will be used for the ownership tender of the National Stadium, National Gymnasium, National Swimming Center, Convention Center, Olympic Village and Related Facilities, Wukesong Culture and Sports Center and Olympic Water Park.
Shanghai, Tianjin, Shenyang, Qingdao and Qinghuangdao Municipalities, which are in charge of the respective Olympic construction projects, will carry out the construction and renovation of the project according to this model.
I. Working Principles of the Tender
1. The Olympic Construction Projects Ownership Tender will be carried out using international public tendering methods.
2. The concept of "Green Olympics", "Hi-Tech Olympics" and "Cultural Olympics" will be realized according to the urban plan requirements of the city.
3. The projects will satisfy technical requirements of the International Olympic Committee and other international sports associations. It will comply with the related rules of The Olympic Charter and Agreement with the Host City.
II. Bidder and his Responsibilities
1. Beijing Municipality along with other related districts and counties will be the "issuer" of tender for the Olympic Construction Projects Ownership Tender. They are responsible for the evaluation of the tender plan, evaluation and approval of the tender documents, determination of the bid winner and contract signing with the bid winner.
2. Beijing Municipality entrusts Beijing Development Plan Committee with the following responsibilities for the tender:
" It will be in charge of handling the draft for the Olympic Construction Projects Ownership Tender
" It will help and guide related departments of the districts and counties in the tendering tasks for the Olympic Construction Projects
" It will coordinate the tendering tasks of related departments, districts, counties and cities
" It will be responsible for the ownership tender of the National Stadium, National Gymnasium, National Swimming Center, Convention Center, Olympic Village and Related Commercial Facilities
3. authorizes Haidian District People's Government to be the "issuer" for the Ownership Tender of Wukesong Culture and Sports Center;
Shunyi District People's Government to be the "issuer" of the Ownership Tender for Olympic Water Park.
III. Major Procedures
1. Tender
1) Tender Information Release. Related information for the tender should be accessed through the websites of Beijing Investment Platform and appointed national news and media.
2) Draft of the Tender Documents. The tender representative organization will draft the ownership tender documents according to the tender plan approved by the municipalities, overall plan approved by the State Planning Commission, "Olympic Charter", "Agreement with the Host City" and technical requirements of the projects specified by BOCOG.
3) Evaluation of the Tender Documents. The approval of the tender documents will be carried out after the evaluation of the special committee organized by the "issuer" of the ownership projects.
4) Release of the Tender Documents. The tender representative organization will issue the tender documents and handle necessary transactions according to laws and regulations.
2. Bid
1) The bidder should submit and send the tender documents to the specified address in the tender documents before the deadline.
2) Two or more entities or organizations can form a single consortium and express who will lead the consortium for the bid.
All parties of the consortium should sign a contract expressing their respective responsibilities and liabilities. This will be included in the Bid Agreement Contract for the tender documents along with others and sent to the specified address in the tender documents.
3. Open Tender
1) The schedule for the open tender should be after the deadline of the submission of the tender documents. The address for the open tender is specified in the tender document.
2) All bidders are invited to participate the open tender. The Notary Bureau will check, authenticate and seal the tendering documents.
4. Tender Evaluation
A tender evaluation committee will be established by the "issuer" to evaluate the tender documents. The committee will submit an evaluation report after independently evaluating the tender documents and recommend best candidates to be the bid winner.
5. Determination of Bid Winner
1) The "issuer" will determine the bid winner according to the recommendations in the evaluation report.
2) The "issuer" will notify both the bid winner and disqualified bidders.
3) The "issuer" and the bid winner will sign the contract.
IV. Supervision
The 29th Olympic Supervision Committee will supervise the tender and bid activities. It will investigate and handle illegal activities according to laws.
V. Supplementary Articles
1. Beijing Development Planning Commission will be in charge of the interpretation of this model.
2. Aside from these specific regulations, Tender and Bidding Law's of the People's Republic of China can also be used for reference for regulations, procedures and content.
3. The tender documents will specify projects, contents, conditions and requirements of the bid.
4. The model will take into effect during the release of the tender documents.
