Question:
Are there any requirements for the Consortium Letter of Intent? (12.2)
Response:
Article 12.2 of the Pre-Qualification Document stipulates that "All members of the Consortium Applicant shall execute a Consortium Letter of Intent for the purpose of submitting a joint bid. The Consortium Letter of Intent shall become part of the application documents for submission to the Tendering Authority". However, there is no specific requirement on the format of the letter, but the content of the letter shall reflect the requirements on Consortium Applicant, as set out in the Pre-Qualification Document.
Question:
What project should be categorized as "cooperative projects between the government and the private sector", as set out in Appendix 9?
Response:
The "cooperative projects between the government and the private sector" includes the following two categories:
- An Applicant is wholly or partially responsible for the investment and operational risks of a project sponsored by government. For example, the Applicant may have equity investment in the project. Alternatively, the Applicant may act as the operation company that operates and manages the project after its completion.
- Where an Applicant acts as the sponsor of the project in the capacity of an agent of the government.
Question:
Will the deadline for submission be extended?
Response:
No, it will not be extended.
Question:
Is it possible for the Tendering Authority to recommend the Applicant to those potential companies that are seeking partners to form a Consortium, or to recommend such potential companies to the Applicant?
Response:
The Tendering Authority will not make those recommendations.
Question:
If one member of a Consortium has the ability to assume the responsibilities of the general contractor for the project, is it permissible to state in the Consortium members' agreement that this member shall assume the role of the general contractor for the project (not applicable to the National Swimming Center Project)?
Response:
The government is in the process of making a decision on this issue.
Question:
May a member of a Consortium apply for another project as a member of a different Consortium? May a Consortium apply for two or more Projects?

Yes, both are permitted. |
